![]() Federal law (COLREGS) require a look out using all sight, hearing, and radar to avoid collision while underway. Even without the cell phone they could be criminally liable. That's also why NJ requires boater safety certificate- you are informed. If you fail to do so, you can be prosecuted.
Lets see what prosecutors do.. A decade ago, some clown on autopilot southbound ran over a 25' whaler(If I remember) ocean side. He was indicted in Ocean County for manslaughter as one guy died on the whaler. More people get run over by larger boats due to an engaged autopilot and no look out, than cell phones I'm sure. Its usually it's too noisy and windy on a running boat to make a phone call.
